1. Acceptance of Terms
These Terms constitute a legal agreement between you (Individual or Organization) and Xylentis Co., Ltd.
We reserve the right to modify, supplement, or update these terms at any time without prior individual notice. Changes will be effective immediately upon posting. Your continued use of the service constitutes acceptance of such changes.
2. Definitions
"Company", "We", "Provider" refers to Xylentis Co., Ltd.
"Services" includes websites, software, applications, hosting, VPS, cloud services, and other IT solutions provided by Xylentis.
"User", "You", "Customer" refers to individuals or organizations registering for services.
"Data" includes all information, files, databases uploaded or stored by Customer on Xylentis systems.
3. Service Regulations
Xylentis provides services on an "as-is" basis. We strive for high quality but do not guarantee uninterrupted or error-free service.
We reserve the right to change, upgrade, suspend, or terminate any feature or part of the service at any time for maintenance or upgrades.
Customers are responsible for preparing devices, internet connection, and other necessary conditions to access the service.
4. Customer Rights & Obligations
Provide accurate, complete registration information and update it when changed. Xylentis is not liable for issues arising from incorrect information.
Keep account information and passwords strictly confidential. You are fully responsible for all activities under your account.
Perform regular data backups. While we have backup solutions, Xylentis is NOT liable for any data loss due to system errors, hackers, or user errors.
Pay service fees in full and on time. We reserve the right to suspend or delete services if payment is overdue.
Comply with applicable laws and cybersecurity regulations.
5. Prohibited Activities
Using services to store or distribute malware, viruses, trojans, spyware.
Conducting DDoS attacks, email spam, phishing, or activities harming Xylentis systems or others.
Storing pornographic, copyright-infringing, reactionary, or illegal content.
Using hosting/VPS for cryptocurrency mining or excessive resource consumption.
Reverse engineering, decompiling, or disassembling Xylentis software.
Insulting, threatening staff, or harming Xylentis reputation.
Reselling services without written approval from Xylentis or intentionally circumventing resource limits (CPU, RAM, Bandwidth).
6. Service Suspension & Termination
Xylentis reserves the right to unilaterally terminate the contract and delete all data immediately if Customer violates these Terms, especially prohibited activities.
In case of termination due to violation, Customer will NOT be refunded any fees paid.
We reserve the right to refuse service to anyone, at any time, for any reason we deem reasonable.
7. Limitation of Liability
In no event shall Xylentis be liable for any indirect, incidental, special, or consequential damages (including lost profits, lost data, business interruption) arising from service use.
Xylentis's total liability for any claims related to the service shall NOT EXCEED the amount you paid us in the last 03 (three) months for the specific service related to the claim.
We are not liable for force majeure events including natural disasters, fire, fiber optic cable cuts, international internet failures, or government bans.
